Agreement Overview
These Terms of Service govern your use of the Uplifto application. By using Uplifto, you agree to these terms. Please read them carefully.
1. Acceptance of Terms
By accessing or using the Uplifto mobile application ("App") operated by Superstrata ("we," "our," or "us"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App.
We reserve the right to modify these Terms at any time. We will notify you of material changes through the App or by email. Your continued use of the App following such notification constitutes acceptance of the modified Terms.
2. Eligibility
To use Uplifto, you must:
- Be at least 13 years of age
- Have the legal capacity to enter into a binding agreement
- Not be prohibited from using the App under applicable laws
If you are between 13 and 18 years old, you must have permission from a parent or legal guardian to use the App.
3. Account Registration
3.1 Account Creation
To access certain features, you must create an account using Google Sign-In or another authentication method we provide. You agree to:
- Provide accurate, current, and complete information
- Maintain the security of your account credentials
- Accept responsibility for all activities under your account
- Notify us immediately of any unauthorized access
3.2 Account Security
You are responsible for maintaining the confidentiality of your account. We are not liable for any loss or damage arising from your failure to protect your account credentials.
4. Subscriptions and Payments
4.1 Uplifto Plus
Uplifto offers a premium subscription service called "Uplifto Plus" that provides access to additional features. Subscriptions are billed through the Google Play Store and are subject to their payment terms.
4.2 Subscription Options
We offer the following subscription plans:
- Monthly: $4.99 per month, billed monthly
- Yearly: $29.99 per year, billed annually (save 50%)
- Lifetime: One-time purchase for permanent access (available during promotional periods only)
4.3 Free Trial
New subscribers may be eligible for a 7-day free trial. During the trial period, you have full access to Uplifto Plus features. If you do not cancel before the trial ends, your subscription will automatically convert to a paid subscription and you will be charged the applicable subscription fee.
4.4 Automatic Renewal
Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period. You can manage and cancel your subscription through your Google Play Store account settings.
4.5 Refunds
All purchases are handled through the Google Play Store. Refund requests must be made through Google Play in accordance with their refund policies. We generally do not offer refunds directly, but may make exceptions in extraordinary circumstances at our sole discretion.
4.6 Price Changes
We reserve the right to change subscription prices. Existing subscribers will be notified in advance and given the option to cancel before the new price takes effect. Price changes will not affect the current billing period.
5. Use of the App
5.1 License Grant
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes.
5.2 Acceptable Use
You agree to use Uplifto responsibly and in compliance with all applicable laws. When using the App, you may:
- Create and track personal goals and habits
- Join and create Circles with other users
- Participate in challenges
- Share your progress with friends and Circle members
- Use insights and recommendations to improve your habits
Prohibited Conduct
You agree NOT to:
- Use the App for any illegal or unauthorized purpose
- Harass, abuse, or harm other users
- Share inappropriate, offensive, or harmful content
- Impersonate others or misrepresent your identity
- Attempt to gain unauthorized access to the App or its systems
- Interfere with or disrupt the App's functionality
- Use automated systems or bots to access the App
- Reverse engineer, decompile, or disassemble the App
- Violate the privacy or rights of other users
- Use the App to send spam or unsolicited communications
6. User Content
6.1 Your Content
You retain ownership of content you create in the App, including goal names, descriptions, and any text you enter. By using the App, you grant us a limited license to store, display, and process your content as necessary to provide the service.
6.2 Content Standards
User-generated content must not:
- Be illegal, harmful, threatening, abusive, or harassing
- Contain hate speech or discrimination
- Infringe on intellectual property rights
- Contain malware, viruses, or harmful code
- Violate the privacy of others
6.3 Content Removal
We reserve the right to remove any content that violates these Terms or is otherwise objectionable, without prior notice.
7. Social Features
7.1 Circles
Circles are groups of users who share progress on common goals. When you join a Circle:
- Your display name and profile photo are visible to other members
- Your goal names and progress are shared with the Circle
- You may receive notifications about Circle activity
7.2 Community Guidelines
When interacting with other users, please:
- Be respectful and supportive
- Provide encouragement, not criticism
- Respect others' privacy and boundaries
- Report inappropriate behavior to us
8. Intellectual Property
8.1 Our Rights
The Uplifto App, including its design, features, content, and underlying technology, is owned by Superstrata and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our prior written consent.
8.2 Trademarks
"Uplifto" and the Uplifto logo are trademarks of Superstrata. You may not use these marks without our prior written permission.
8.3 Feedback
If you provide suggestions, ideas, or feedback about the App, you grant us the right to use and implement such feedback without compensation or attribution.
9. Third-Party Services
The App may integrate with or contain links to third-party services (such as Google for authentication). These services are governed by their own terms and privacy policies. We are not responsible for third-party services.
10. Disclaimers
Important Disclaimers
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT:
- The App will be uninterrupted, secure, or error-free
- Results from using the App will be accurate or reliable
- The App will meet your specific requirements
Uplifto is a habit tracking tool and does not provide medical, health, or professional advice. Always consult qualified professionals for health-related decisions.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SUPERSTRATA AND ITS AFFILIATES SHALL NOT BE LIABLE FOR:
- Any indirect, incidental, special, consequential, or punitive damages
- Loss of profits, data, use, goodwill, or other intangible losses
- Damages resulting from unauthorized access to your account
- Any conduct or content of third parties on the App
Our total liability for any claims arising from these Terms or your use of the App shall not exceed the amount you paid us, if any, in the twelve (12) months preceding the claim.
12. Indemnification
You agree to indemnify, defend, and hold harmless Superstrata and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including legal fees) arising from:
- Your use of the App
- Your violation of these Terms
- Your violation of any rights of another party
- Your content or data submitted to the App
13. Termination
13.1 By You
You may stop using the App and delete your account at any time through the App settings or by contacting us.
13.2 By Us
We may suspend or terminate your access to the App at any time, with or without cause, and with or without notice. Reasons for termination may include:
- Violation of these Terms
- Conduct that may harm us or other users
- Extended periods of inactivity
- Requests from law enforcement
13.3 Effect of Termination
Upon termination, your right to use the App ceases immediately. We may delete your account and data, though some provisions of these Terms will survive termination.
14. Dispute Resolution
14.1 Informal Resolution
Before filing any legal claim, you agree to try to resolve disputes informally by contacting us at legal@superstrata.dev. We will attempt to resolve the dispute within 30 days.
14.2 Governing Law
These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles.
15. General Provisions
15.1 Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Superstrata regarding the App.
15.2 Severability
If any provision of these Terms is found unenforceable, the remaining provisions will continue in full force and effect.
15.3 Waiver
Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
15.4 Assignment
You may not assign or transfer your rights under these Terms without our consent. We may assign our rights without restriction.
